General Terms and Conditions

1. Scope
These terms and conditions apply to all quotes, services and contracts between FG Facility Gebäudeservice, Funda Gürel, and its customers, unless otherwise agreed in writing.
2. Services
The type and scope of services follow from the respective quote, schedule of services or individual contract. Changes and additional services require a separate agreement.
3. Quotes and conclusion of contract
Quotes are subject to change unless expressly marked as binding. A contract is concluded by written order confirmation or by the actual performance of the service.
4. Prices and payment terms
The prices agreed in the quote or contract apply. Invoices are due without deduction within 14 days of the invoice date unless otherwise agreed. In the event of late payment, the statutory provisions apply.
5. Customer's duty to cooperate
The customer shall provide all information, access and prerequisites required for the performance of the services in good time. Delays caused by a lack of cooperation are not the responsibility of FG Facility Gebäudeservice.
6. Liability
FG Facility Gebäudeservice is liable without limitation in cases of intent and gross negligence as well as for damages arising from injury to life, body or health. In cases of slight negligence, FG Facility Gebäudeservice is liable only for the breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for such contracts.
7. Warranty and defects
Complaints must be reported in writing without undue delay after becoming known. FG Facility Gebäudeservice shall be given the opportunity to remedy the defect where this is provided for by law.
8. Term and termination
Contract terms and notice periods are governed by the respective agreement. The right to extraordinary termination for good cause remains unaffected.
9. Confidentiality and data protection
Both parties shall treat confidential information of the other party as confidential. The provisions of the privacy policy apply in addition.
10. Final provisions
German law applies. To the extent permitted by law, the place of jurisdiction is Munich. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
